Thai Family Visa FAQ

FAQ: Top questions about the "Marriage Visa and Thai Family Visa (Non-O)" by Ethaivisa

It is a visa for foreign nationals who are legally married to a Thai national, allowing the couple to live together in Thailand on a long-term basis. The visa is issued under the Non-Immigrant O category.

Under immigration rules, the two cases are completely different: • Foreign husband (with a Thai wife): you must show a deposit of at least 400,000 THB in a Thai bank account (held untouched for at least 2 months before applying), or an income of at least 40,000 THB/month. • Foreign wife (with a Thai husband): you do not need to show the 400,000 THB deposit, but your Thai husband must provide proof of tax payments or income sufficient to support his wife, in line with immigration criteria.

Yes! Since Thailand officially enacted the Marriage Equality Act, foreign LGBTQ+ partners who have registered their marriage with a Thai national can apply for a Marriage Visa (Non-O Marriage) under exactly the same criteria and conditions as opposite-sex spouses.

Yes, you can, but there are additional steps. Your foreign marriage certificate must first be translated into Thai and legalized by the Thai Ministry of Foreign Affairs. You then need to have the marriage recorded in the family registration database (KR.22) at a district office in Thailand before it can be used to apply for the Marriage Visa.

It must be a savings or fixed deposit account in the foreign national's name ONLY. A joint account with your wife cannot be used. The funds must remain untouched, with absolutely no withdrawals, for at least 2 months before applying in the first year, and 3 months in subsequent years.

Yes! This is one of the legal advantages of the Marriage Visa. Foreigners holding a Non-O Marriage Visa can look for a job and have their employer apply for a Work Permit directly, without changing back to a Non-B visa. The company is also exempt from the registered capital requirement and the ratio of 4 Thai employees per 1 foreigner.

It is a visa for a foreign father or mother who has a child of Thai nationality and wishes to stay in Thailand to care for the child. It is typically used when the foreign parent is not married to the child's Thai mother or father, or when the couple has divorced but the foreign parent remains responsible for the Thai child.

The same criteria apply as for a foreign husband's Marriage Visa: the foreign parent must have at least 400,000 THB deposited in a Thai bank account, or proof of income of at least 40,000 THB/month, to demonstrate sufficient means to support the Thai child.

Yes, but a legal process must be completed first. A foreign father can apply for this visa only after he has registered legitimation of the child at a district office, or holds a Juvenile and Family Court order clearly stating that he is the legal father and shares parental authority. (Having your name on the birth certificate alone is not accepted by immigration.)

It is easier than for a foreign father. Under Thai law, a child born to an unmarried mother is automatically regarded as the mother's legitimate child. A foreign mother can therefore use the child's birth certificate to support her Thai Child Support Visa application straight away.

Immigration allows foreigners to extend the Thai Child Support Visa until the child reaches the full age of 20 (legal adulthood). Once the child is over 20, the foreign parent can no longer rely on supporting a minor and must change to another visa type.

It is the reverse of the previous case. It is a visa for elderly foreign parents who have an adult Thai child (over 20 and working). The Thai child applies to support and care for the foreign parents so that they can live in Thailand.

In this case, the foreign parents do not need to show the 400,000 THB deposit. Instead, immigration assesses the Thai child, who must provide proof of income, tax payments or savings demonstrating that they can comfortably support their foreign parents.

There is no fixed minimum age for the parents, unlike the Retirement Visa (which requires applicants to be 50 or older). Immigration mainly considers the blood relationship. As long as the family bond is proven and the Thai child is able to support the parents, you can apply for an extension of stay.

Yes. Foreigners can apply for a change of visa type to Non-O in Thailand at the Chaeng Watthana immigration office (or the local immigration office). Your current tourist visa must have at least 15 working days remaining, and you must prepare complete family documents and proof of funds in line with the criteria.

Because immigration is very strict about sham marriages and paid marriage registrations. Officers need 30 days to forward your information to a provincial-level committee for review, and immigration officers may make random on-site visits to your actual home during this period.

We strongly advise against it. During these 30 days, local immigration officers may visit your home unannounced. If they find that the foreign spouse is not actually living there, the case may be suspended or refused immediately. The only exception is a genuine emergency, which requires case-by-case approval from the head of the immigration checkpoint.

Officers check whether the couple genuinely live together. They will ask to see the bedroom, clothing and personal belongings, take photos of the couple together in the home and, importantly, interview neighbours or the building's juristic person office to confirm that the foreigner regularly lives with his/her Thai spouse.

Family photos must be clear and natural. You need a photo of the couple in front of the house with the house number clearly visible, photos together in the living room and bedroom, and shots showing the home environment. The map must accurately show the route from the main road to the house, so that immigration officers can easily find their way for a home visit.

The Marriage Visa ends immediately on the date the divorce is registered. The foreigner can no longer stay on the basis of marriage and must leave the country or promptly change visa type (for example, if the couple has children, the foreign parent may switch to a Thai Child Support Visa instead).

The original Marriage Visa entitlement ends. However, immigration offers humanitarian relief: if the foreigner has ties or assets in Thailand, or needs to stay to handle the estate and funeral, they can apply for a temporary extension of stay on special grounds for 60-90 days at a time. If the couple has a Thai child, the foreigner can switch to a Thai Child Support Visa instead.

Once your annual visa stamp has been issued, immigration rules allow you to withdraw money for expenses, but not the full amount. The strict rule is that the account balance must never fall below 200,000 THB throughout the year, and you must top it back up to 400,000 THB at least 3 months before your next annual visa extension.

This happens very often. If the funds have not been held for the required period, immigration will not grant a 1-year extension. The solution is to have ETHAIVISA coordinate a short-term extension of stay of 30-60 days with immigration, giving your funds time to reach the legally required holding period, or to plan a switch to the income-based route instead.

KR.3 is the decorative marriage certificate with the marriage registration frame, while KR.2 is the marriage registration record containing the registry office's detailed entries. When you apply for a Marriage Visa, immigration mainly checks a certified copy of KR.2 issued within the last 1 month, because it shows your current status and confirms that you have not divorced.

Family visas are among the types that immigration scrutinises most closely, with in-depth document checks, interviews and real home visits. If financial documents are missing, translations lack certification stamps, or interview answers do not match, the case will be refused and you risk being accused of a sham marriage. The ETHAIVISA team has first-hand experience in assembling complete document sets, reviewing bank accounts and guiding you through preparing for immigration interviews at every step, turning a stressful process into one that is simple, convenient and as safe as possible for your family relationship.
