Work Permit Cancellation & WP 53 Services

Notifying a foreigner's termination of employment and cancelling a business work permit under Form BT.53 has strict requirements and legal timeframes specified in the Royal Decree on Foreign Workers Management, as follows

📌 Key conditions for filing a cancellation (BT.53)

  1. Mandatory timeframe: the employer must file Form BT.53 within 15 days from the date the foreigner leaves the job or the employment contract actually ends (a fine of up to 20,000 baht applies if delayed)
  2. Effective date: the date of termination stated on the BT.53 document must match the Social Security termination document (SPS.-09) and the actual last date of salary payment
  3. Impact on the visa: as soon as the work permit is cancelled, the foreigner's work visa (Non-Immigrant B) will end on the same day (a visa cancellation must be filed at Immigration immediately)

📋 Document list

All documents must have complete information printed, and must be signed by an authorized director and stamped with the company seal on the employer's portion of documents

Part 1: Application documents and evidence for the foreigner
  • Original Notification of Foreign Employee Termination form (Form BT.53)
  • Work Permit
    • For the booklet type: bring the original booklet to return to the officer
    • For Digital Work Permit: attach a copy of the screen showing the details in the application
  • Copy of the foreigner's passport (Passport)
    • First page (personal information)
    • Work visa page (Non-B) and the latest stay extension stamp
  • Copy of the resignation letter (Letter of Resignation) or termination letter (Termination Letter) clearly stating the last day of employment
Part 2: Documents of the employer company (juristic person)
  • Copy of the company registration certificate (latest updated version, issued no more than 6 months ago)
  • Copy of the national ID card of the authorized director (in the case of a foreign director, use a copy of the passport and a copy of the Work Permit)
Part 3: Documents for power of attorney (in case ETHAIVISA acts on your behalf)
  • Power of attorney letter from the employer company, with a 10-baht duty stamp affixed
  • Copy of the national ID card of the authorized representative

💡 Special advice from ETHAIVISA

  • If the employee does not return the booklet or cannot be reached: if the employee absconds or refuses to hand over the original Work Permit booklet to the company, the company can still file Form BT.53 as normal, by attaching an additional letter explaining the reason, to prevent the company from being fined for a late termination notification.
  • Forward the information to the HR team: after receiving the BT.53 receipt from the Department of Employment, the HR department must promptly send this document to the foreigner to attach when filing the visa cancellation at Immigration within the timeframe, so that the record of both the company and the foreigner remains clean, with no issues when applying for a new visa or Work Permit in the future.

Work Permit Cancellation & WP 53 Services FAQ

Frequently asked questions about canceling and returning a business work permit

The main form is BT.53 (notification of a foreign national leaving employment), together with the original Work Permit book (if any), the company certificate and a copy of the foreign national's passport.

It must be notified within 15 days from the date the foreign national's employment contract ended or they actually left the job.

The employing company faces a criminal fine under labour law of up to 20,000 THB.

It must be the last actual day of employment according to the resignation letter or termination letter, not the date the documents are processed.

When the Work Permit is cancelled, the work visa tied to that company automatically ends on the same day. The foreign national must then go to the immigration office immediately to cancel the visa.

Yes. Whatever the reason for leaving (resignation, termination or end of contract), the BT.53 form must always be used to notify the departure from employment.

No physical book needs to be returned. The system will revoke the rights and cancel the status in the online application once the officer has approved the BT.53 form.

Yes. The company can submit a letter to the Department of Employment explaining that it cannot return the original book because the employee has not handed it back.

Yes. The employer can issue a power of attorney (with stamp duty affixed as required by law) authorising us to handle every step on its behalf.

Normally, when you cancel your work visa at the immigration office, the officer will allow a further 7 days to prepare to leave (immigration fee of 1,900 THB).

The company must promptly file the BT.53 form to notify the departure from employment, stating the date of absence or end of employment, and may also file a police daily report as evidence to submit to the immigration office and the Department of Employment.

No. The Department of Employment will only accept and enter it into the system on or after the actual last day of employment stated in the documents.

There is no government fee for notifying a departure from employment and returning the Work Permit.

Yes, the old one must be cancelled first to clear the system, so that an application can be filed or the employee can be registered with the new company.

For filing the BT.53 (returning the book), the employer can act on their behalf. However, for the visa cancellation at the immigration office, the foreign national must attend in person to receive the cancellation stamp in their passport.

Yes. The validity of the visa and the Work Permit are separate. Even if the visa has expired, when the employment contract ends the employer is still legally required to file the BT.53.

The officer stamps the cancellation effective from the actual last day of employment, as stated in the company's notification letter and the BT.53 form.

The visa will not be properly cancelled. If you return in the future, the immigration system may show an outstanding overstay record, which carries a fine and may result in you being refused entry.

Yes. A departure from employment must be filed for every foreign employee, using the date the company registered its dissolution as the end-of-employment date.

It must be filed at the Bangkok Employment Office Area 1-10 covering the company's location, or at the one-stop service centre the company is entitled to use (such as Chamchuri Square or One Bangkok).

The company will receive a copy of the BT.53 bearing the receipt stamp and the signature of the employment officer, as evidence confirming that the company has complied correctly.

The Dependent Visas end at the same time as the foreign employee's main visa, and must be cancelled at the immigration office at the same time.

No. Normally you must leave the country first and then obtain a tourist visa to re-enter, or apply for a change of visa type under the immigration office's special conditions on a case-by-case basis.

The leaving date must reflect the truth and match the accounting and social security records. Misrepresenting information in official documents carries a risk of breaking the law.

Because we precisely coordinate the timeline between the end-of-employment date, the BT.53 filing and the immigration appointment, preventing mistakes with the 15-day deadline, reducing HR's workload and fully protecting the company from fines.
