For a smooth approval, the company and the applicant must meet the basic legal requirements:

  1. Supported visa: the foreign national must enter with a Non-Immigrant B (temporary stay for work) visa, or a visa type that is legally permitted to work
  2. Specialist qualifications: the specialist-level applicant must hold an educational qualification relevant to the field, or a clear certificate of work experience in that position from their previous company
  3. Company ratio: for every 2,000,000 baht of the company's paid-up registered capital, the company may employ 1 foreign national (along with the ratio of Thai national employees required by law)

New Thailand Work Permit Application FAQ

Frequently Asked Questions: First-time Work Permit Application, Specialist Level (General Business)

If the foreign national is still abroad, the Thai employer must submit a Work Permit application on their behalf in advance using form BT.32 (BP.32). If the foreign national has already entered Thailand on a Non-B visa, form BT.25 is used to apply for the actual Work Permit.

BT.32 is the document the employer submits to the Department of Employment to obtain advance approval to hire (while the foreign national is still outside Thailand). Once approved, the employer receives a 'Work Permit approval notification letter', which is sent to the foreign national to attach to their Non-B visa application at a Royal Thai Embassy abroad so they can fly into Thailand.

It considers 3 main factors: 1. an educational qualification relevant to the position; 2. work experience letters from previous employers; and 3. the nature of the job, which must require specialised skills, must not be general labour, and must not be among the occupations prohibited to foreign nationals.

It is a mandatory form that the employer completes to certify the terms of employment, including the job title, duties and responsibilities, and salary. It must be attached to every BT.32 or BT.25 application.

For a standard application with the Department of Employment (in Bangkok or at a provincial employment office), approval and issuance of the Work Permit take approximately 3 - 7 working days once all documents are complete.

As a standard, you should hold at least a bachelor's degree related to the position. If your degree is in an unrelated field or you do not have a bachelor's degree, you will need to submit work experience letters from previous employers to demonstrate your skills instead.

It must be issued by your previous employer abroad (or in Thailand if you worked there legally) and clearly state your name, position and period of employment. For a skilled-level application, you should have at least 5 years of cumulative experience in the relevant field.

It must be issued by a clinic or hospital in Thailand only (medical certificates from abroad are not accepted). The doctor must certify that you are free of all 6 prohibited diseases specified in the ministerial regulation, and the certificate must be no more than 30 days old, counted from the date of examination to the date of submission.

You will need 3 front-facing photos, 3x4 cm, in neat attire, without a hat or dark glasses (taken within the last 6 months, with a white or dark blue background as required by each local office).

You must scan and submit both passports together. Show the bio page of the new passport, and the Non-B visa page and the latest entry stamp in the old passport, so that officers can verify the link between the two in the system.

The company must have fully paid-up registered capital of at least 2,000,000 THB to obtain a Work Permit for 1 foreign national (to hire a 2nd foreign employee, the capital must increase to 4,000,000 THB).

Yes, it applies immediately. When applying for a first Work Permit, the company must attach proof of social security contributions (SPS.1-10) for 4 Thai employees covering at least 3 full months, to confirm that it genuinely employs Thai nationals in the ratio required by law.

This is quite difficult through the standard process. Officers usually put such cases on hold until they can see established tax and social security records. The options are for the company to have the foreign national apply for a work visa from abroad, or to contact ethaivisa so we can help plan a strategy, prepare the company's structural documents and explain the business necessity to the Director-General of the Department of Employment as a special case.

The company must prepare its company certificate with business objectives, list of shareholders (BOJ.5), VAT registration certificate (PP.20), and latest annual financial statements audited by a licensed auditor. All copies must be recent, no more than 3-6 months old.

You need a clearly drawn map showing the location, together with company photos showing: the company name sign in front of the building, the address number, and the inside of the office with Thai employees actually working. This demonstrates that the business has a stable, genuine workplace and is not a 'ghost office'.

The minimum salary varies by the foreign national's nationality. For example, nationals of Europe, the USA, Australia and Japan require a minimum of 50,000 THB/month; South Korea, Singapore and Hong Kong 45,000 THB/month; and ASEAN countries (e.g. the Philippines) a minimum of 25,000 THB/month. This figure must be stated correctly in the employment contract in line with immigration criteria.

As soon as the foreign national receives the Work Permit, the company must use that salary to calculate withholding tax and file PND.1 (employee income tax) with the Revenue Department every month. Never report a lower amount than the salary stated in the Work Permit, as the immigration office will detect it at the annual visa extension.

Fees are based on the validity period approved: validity up to 3 months: 750 THB; more than 3 months but not more than 6 months: 1,500 THB; more than 6 months but not more than 1 year (standard): 3,000 THB (plus an application fee of 100 THB per form).

Absolutely not. The foreign national may only work in the position, duties and work location printed in the Work Permit. Taking on outside work, working at other branches, or changing position without notifying the authorities and amending the permit is an immediate offence under labour law.

For general businesses (non-BOI), officers usually approve the first Work Permit for no more than 1 year (or to match the validity of the Non-B visa the foreign national holds at that time). As the expiry date approaches, you then apply for the annual renewal.

Yes, and the company requirements are also relaxed. A company hiring a foreign national on a Non-O Marriage Visa needs registered capital of only 1,000,000 THB and a ratio of only 2 Thai employees per 1 foreign employee (instead of the usual 4:1).

First, promptly file a police report and obtain a new passport from your own embassy. Then contact the immigration office to have your existing visa stamp transferred to the new passport, and only then submit the new passport to the Department of Employment to continue the Work Permit issuance process.

Yes, you can apply to add it. However, when completing form BT.25 or the amendment form, you must provide a detailed explanation of the business necessity, i.e. why one person needs to oversee both departments, and the job duties must not conflict with the laws on the employment of foreign nationals.

You can file an appeal within 30 days. We will need to gather Experience Certificates from several previous employers and present the information coherently to show the committee that, although the degree does not match, this foreign national has long, genuine hands-on expertise that compensates for the qualification. For technical cases like this, ethaivisa has a team experienced in drafting appeals to help resolve the matter.

Because the first application is the most important stage for 'setting up the structure'. If the job title on form BT.32 does not align with the company's financial statements, or the Thai employees' social security records are not yet stable, the case will be returned and the system locked immediately, delaying the timeline for bringing your specialist into Thailand. The ethaivisa team acts as your personal secretary, reviewing your balance sheet and handling forms BT.32, BT.46 and BT.25 seamlessly, so your organisation can bring in foreign experts to drive the business correctly, quickly and successfully in a single round.
