Work Permit Renewal

Conditions and document list for renewing a business-type work permit in Thailand

Renewing a work permit for business-type employment has strict rules and legal timeframes. The employing company and the foreign employee must jointly prepare complete documents, as follows

Key conditions for filing a Work Permit renewal

  1. Must be filed before expiry: the renewal application must be filed "before" the current work permit expires (it is recommended to start preparing documents 30-45 days in advance)
  2. Visa status must be consistent: the foreigner must hold a temporary work visa (Non-Immigrant B) or another visa type that legally permits employment, and must renew the visa concurrently
  3. Company ratio criteria: the company must maintain the required paid-up registered capital ratio (every 2,000,000 baht per foreign employee) and the ratio of Thai to foreign employees as legally required, correctly
  4. Tax and social security payments: the company must have evidence of continuous, regular tax and social security contribution payments for all employees

📋 What documents are required?

Documents are divided into 2 main parts: the foreign employee's portion and the employer company's portion:

Part 1: Foreign employee documents (Employee Documents)
  • Work permit renewal application form (BT.25) with a 3x4 cm photo (taken no more than 6 months ago)
  • Work Permit original booklet or Digital Work Permit system (according to the format received)
  • Passport original with a copy of the personal information page, the Non-B visa page, and the latest stay extension stamp
  • Original medical certificate (issued no more than 1 month ago) confirming the applicant does not have a prohibited disease as legally required
  • Evidence of personal income tax payment (PND.91 or PND.90) for the latest tax year, with a receipt (if any)
Part 2: Employer company documents (Employer Documents)
  • Company registration certificate (issued no more than 6 months ago) with its objectives
  • List of shareholders (BOJ.5) (issued no more than 6 months ago)
  • VAT registration certificate (PP.20)
  • Latest annual financial statements (balance sheet and profit and loss statement) audited and certified by a licensed auditor
  • VAT return form (PP.30) for the last 3 months, with receipts
  • Withholding tax return form (PND.1) listing both Thai and foreign employees, for the last 3 months, with receipts
  • Evidence of social security contribution payments (SPS.-10) for the last 3 months, with receipts

💡 Advice and warnings from ETHAIVISA

  • Never let it expire: if the work permit expires before the renewal application is filed, the foreigner will not be able to legally work, and will have to start the first-time application process again, which is much more difficult and time-consuming
  • Check the minimum wage criteria: the foreign employee's salary must not be lower than the minimum criteria set by the Ministry of Labour for each nationality (for example, Western nationalities/Japan not lower than 50,000 baht, India/Philippines have specific group criteria, etc.)
  • Document signing: all company-side documents must be signed by the authorized director as per the certificate, and stamped with the company seal on every page

Work Permit Renewal FAQ

Frequently asked questions: renewing a business-type Work Permit (Work Permit Renewal)

Under the standard rules, you can apply for a renewal up to 30 days before your current permit expires. The single most important rule is that the renewal application must be submitted before the expiry date shown in the permit book or in the system — never let it lapse, not even by one day.

No, absolutely not. Once a permit expires, the previous right to work is void immediately. The foreign employee can no longer work, and the company must start the Work Permit process again "from scratch as a first-time application" (New Application), which means preparing all the company documents and having educational qualifications verified all over again.

Since late last year and continuing into the present (2026), the Department of Employment has enforced the online e-Work Permit system for almost 100% of Work Permit applications and renewals. Employers must submit documents, upload scanned files and pay fees entirely through electronic channels, which spares you the hassle of carrying thick stacks of paper documents to the employment office.

For the traditional paper book system (Non-BOI), once the online system approves the renewal, the foreign employee or an authorised representative still needs to take the original book to the local employment office to have the renewal stamped. With the Digital Work Permit system (for BOI companies), however, the permit is updated on the smartphone app immediately after approval, with no need to visit the employment office.

Yes, they can continue working as normal and fully within the law. As long as you submit the renewal application (and receive the BT.25 application receipt in the system) before the original expiry date, labour law allows the foreign national to keep working in the meantime until the registrar approves or rejects the application.

For general foreign workers (the Non-Immigrant group), the renewal application under Section 67, known as "Form BT.25", is submitted through the e-Work Permit online system. You must complete your personal details and your current employer's details in full.

There are 4 main items: 1. Original passport — the bio-data page and the current visa page; 2. The existing Work Permit book (if any); 3. An employment certificate (Form BT.46); and 4. A medical certificate screening for prohibited diseases.

It must be a medical certificate issued by a hospital or clinic in Thailand, certifying that you are free of the 6 diseases prohibited by law (such as tuberculosis in its infectious stage, third-stage syphilis, drug addiction and chronic alcoholism). The certificate must be no more than 30 days old, counted from the date of the examination to the date the application is submitted in the system.

Use a colour, front-facing photo in neat attire against a white or dark blue background, sized 3x4 cm (or 1.5 inches), taken within the last 6 months. The image file must be high-resolution and sharp, not blurry.

It must state the employee's name, the company name, the job title, duties and responsibilities, and "a salary rate equal to that of the previous year" (it may increase but must not fall below the minimum for the employee's nationality). An authorised director of the company must sign it and affix the company seal.

You will need the company certificate and statement of objectives (latest copy, issued within 6 months), the list of shareholders (BOJ.5), the VAT registration certificate (PP.20), and the latest audited financial statements.

The immigration office and the employment office check this very strictly. The foreign employee must attach "a copy of the annual personal income tax return (PND.90 or PND.91)" for the previous tax year, together with the Revenue Department receipt, to confirm that they genuinely work and pay tax correctly in Thailand.

Yes, it is. You need copies of the PND.1 (employee salary tax) for the most recent 3 months, clearly showing the foreign employee's name, together with the barcoded receipts from the Revenue Department system.

Yes, and the figures must be consistent. General (Non-BOI) companies must attach social security submission records (SPS.1-10) for the most recent 3 months, showing the full ratio of 4 Thai employees per 1 foreign employee continuously. If the number of Thai staff fell short at any point during the past 3 months, the application will run into problems and the renewal cannot be processed.

Yes, it can. An accounting loss is not an absolute bar to renewing a Work Permit, as long as the company still has working cash flow and files taxes and employee social security correctly. However, officials may ask to see the company's bank statements to check its liquidity.

Fees depend on the period approved (excluding the 100 THB application fee): renewal of up to 3 months: 750 THB; renewal of 3 - 6 months: 1,500 THB; renewal of 6 months - 1 year (standard): 3,000 THB; renewal of more than 1 year but not more than 2 years (for certain cases/BOI): 6,000 THB.

For a regular business company, the registrar generally approves 1 year at a time.

The smoothest approach in practice is to "first apply for the Non-B visa extension at the immigration office and obtain the 30-day 'under consideration' stamp". Then upload the passport page bearing that stamp into the system to proceed with the Work Permit renewal, because the employment office will not approve a Work Permit if the visa itself has already expired.

Once you have the full 1-year visa stamp from the immigration office, promptly scan the actual visa page and update it in the e-Work Permit system again, so that the employment office can extend your Work Permit's expiry date to a full year, matching the visa.

A reduced requirement applies. Foreign nationals who obtained their Work Permit on the basis of a Marriage Visa need only 2 Thai employees (instead of the usual 4) at their annual renewal, and the company's registered capital requirement is only 1 million THB — a significant saving for the company.

Yes, it will. The employment office and the immigration office will only stamp a renewal up to the passport's expiry date (so only 6 months). The foreign employee should obtain a new passport promptly, transfer the visa to it, and then apply to renew the Work Permit for the remaining period afterwards.

For temporary business visits or meetings, no notification is needed. However, if the employee will be stationed at that site full-time, supervising work for more than 15-30 days, we recommend adding the work location to the Work Permit system in advance at the time of renewal, to be safe during official inspections.

Under the Department of Employment's 2026 guidelines, if the e-Work Permit system has technical problems, the employer can take a screenshot of the error and submit paper documents manually at the local employment office as a special concession, so that the foreign employee's rights do not lapse.

The difference is the submission channel. BOI companies renew directly through the BOI's Single Window system rather than the Department of Employment's general e-Work Permit system. Once approved, the details appear immediately in the app on the foreign employee's phone, with no stamp in a paper book.

The system has now moved 100% online to e-Work Permit, with strict requirements for file uploads, Revenue Department tax barcode checks, and expiry timelines tightly linked to the immigration office. If tax filings do not match, or the wrong type of medical certificate file is attached, the system will reject the case immediately, which could leave the foreign employee working illegally. The ethaivisa team has professionals who manage in-depth document scanning, coordinate with your accounting department, and control the employment office and immigration timelines end to end, so your foreign staff and executives get their Work Permits renewed smoothly and correctly, with no disruption to your business.
